Academic Year 113: Toxicity and concerns about chemical hazards should be reported to the Environmental Protection Agency within 30 minutes. Please pay attention to safety when handling hazardous chemicals.
According to Article 41 of the Toxic and Concern Chemical Substances Management Act, if there is a risk of contamination of the environment outside the perimeter of the operation site due to leakage, chemical reaction or other sudden accidents, the operator should report it to the local competent authority (the New Taipei City Environmental Protection Bureau in New Taipei City) within 30 minutes at the latest. Failure to report in time will result in a fine of more than NT$1 million. Please be sure to pay attention to safety when operating toxic chemicals.
Toxic and Concern Chemical Substances Management Act:
Article 41
When any of the following circumstances occur with toxic chemical substances or chemical substances of concern that are designated and announced as hazardous by the central competent authority, the operator shall immediately take emergency prevention measures and report the accident to the municipal, county (city) competent authority where the accident occurred within 30 minutes at the latest:
1. There is a risk of contaminating the environment outside the perimeter of the operation site due to leakage, chemical reaction or other sudden accidents.
2. An unexpected accident occurs during transportation, which may pollute the environment or endanger human health.
The notification method referred to in the preceding paragraph shall be announced by the central competent authority.
In the event of any of the circumstances in the first paragraph, the competent authority may, in addition to ordering the enterprise to take necessary measures, also order the enterprise to suspend part or all of the operations related to the accident. If necessary, the competent authority may directly take measures to deal with the situation.
When an unexpected accident occurs during transportation as specified in Subparagraph 2 of Paragraph 1, the operator or owner shall dispatch professional response personnel or entrust a professional response agency (institution) to the scene of the accident within two hours to be responsible for the accident response and aftermath handling.
In addition to being responsible for clearing up the accident in accordance with relevant regulations after the accident occurs, the operator in Paragraph 1 shall also prepare a written investigation and handling report in accordance with regulations and submit it to the competent authority for record. The format, content, matters to be recorded and other matters to be complied with of the report shall be determined by the central competent authority.
